Man with Van Lambeth Terms and Conditions of Service

These Terms and Conditions set out the basis on which Man with Van Lambeth provides removal and related services to private and business customers. By making a booking, using our services, or allowing our staff to carry out work on your premises, you agree to be bound by these Terms and Conditions. Please read them carefully before confirming any booking.

Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means the person, firm, or company who requests or uses our services.

Company means Man with Van Lambeth, providing removal and associated services.

Services means any removal, delivery, collection, loading, unloading, packing, storage, or related services provided by the Company.

Goods means the items, belongings, or materials which the Company is requested to move, handle, store, or otherwise deal with.

Vehicle means any van or other vehicle used by the Company to provide the Services.

Working Day means any day other than a Saturday, Sunday, or public holiday in England.

Scope of Services

The Company provides man and van services, including but not limited to household removals, small office moves, collection and delivery of items, furniture transport, and related assistance within Lambeth and surrounding areas, and to and from other locations in the United Kingdom.

The specific details of the Services, including locations, dates, times, and any special requirements, will be agreed with the Customer at the time of booking. Any services not expressly agreed in advance will be at the Companys discretion and may incur additional charges.

Booking Process

All bookings are subject to availability and acceptance by the Company. A booking is not confirmed until the Company has provided written or electronic confirmation setting out the agreed date, time window, service description, and applicable charges.

The Customer is responsible for providing accurate and complete information at the time of enquiry and booking, including but not limited to:

Full collection and delivery addresses.

Accurate description and approximate quantity or volume of Goods.

Details of any large, heavy, fragile, or high-value items.

Access details, such as floor levels, lifts, stairs, parking restrictions, loading bays, and any known access limitations.

Any special handling requirements or time constraints.

The Company reserves the right to amend the quoted price or cancel the booking if the information provided by the Customer is inaccurate or incomplete, or if the actual circumstances on the day differ substantially from those described at the time of booking.

Quotations and Pricing

Quotations are based on the information supplied by the Customer and are normally provided as either a fixed price or an hourly rate. All quotations are exclusive of congestion charges, tolls, parking fees, fines, or additional access costs unless expressly stated otherwise.

Quotations are valid for a limited period as specified by the Company at the time they are provided. The Company may withdraw or revise a quotation if the Customer does not confirm the booking within the validity period or if circumstances change.

Additional charges may apply where:

There are delays beyond the reasonable control of the Company.

Access is more difficult than advised or requires extra time or personnel.

Additional items not declared at booking need to be moved.

Waiting time is incurred due to keys, paperwork, or premises not being ready.

Work is required outside agreed hours or on short notice.

Payments

The Customer must pay all charges in accordance with the payment terms confirmed by the Company at the time of booking. Unless otherwise agreed in writing:

For private customers, payment is typically due in full either in advance or on completion of the service on the same day.

For business customers, payment terms may be agreed on account, subject to credit approval, and will be set out in separate correspondence or invoices.

The Company reserves the right to request a deposit or full prepayment to secure a booking, particularly for larger moves, long-distance jobs, or peak periods.

If payment is not received when due, the Company may:

Refuse to carry out or complete the Services.

Retain Goods in its possession until payment is made in full.

Charge interest on overdue amounts at the statutory rate applicable in England and Wales.

The Customer is responsible for any bank charges, transfer fees, or other costs associated with making payment to the Company.

Cancellations and Amendments

The Customer may cancel or amend a booking by giving notice to the Company. The following cancellation terms will generally apply, unless otherwise specified in writing:

Where more than 48 hours notice is given before the scheduled start time, any deposit paid may be refunded or applied to a rebooked date at the Companys discretion.

Where between 24 and 48 hours notice is given, the Company may retain part or all of the deposit and may charge a reasonable cancellation fee.

Where less than 24 hours notice is given, or the Customer fails to be present or ready at the agreed time, the Company may charge up to the full quoted amount to cover the allocated time and vehicle.

If the Customer wishes to change the date, time, or scope of the Services, the Company will seek to accommodate the change but cannot guarantee availability. Amendments may result in revised pricing, and any increased charges must be accepted by the Customer before changes are confirmed.

The Company may cancel or postpone the Services where:

Weather or road conditions make it unsafe to operate.

Staff are unable to attend due to illness or other emergency and no replacement is reasonably available.

The Customer has not provided accurate information or necessary access.

There is any safety risk or legal restriction preventing the work from being carried out.

In such cases, the Company will aim to reschedule the Services at the earliest mutually convenient time. The Company will not be liable for any indirect losses arising from such cancellation or postponement.

Customer Responsibilities

The Customer is responsible for:

Ensuring that the Goods are suitably packed, boxed, or protected, unless packing services are specifically included in the booking.

Securing or disconnecting appliances, fixtures, and fittings prior to removal, unless otherwise agreed.

Ensuring that all Goods to be moved are ready and accessible at the agreed start time.

Arranging suitable parking and, where necessary, any permits or permissions required for the Vehicle to load and unload at both collection and delivery addresses.

Supervising loading and unloading where necessary and ensuring that no Goods are left behind in the property once the service is complete.

Checking the premises before the team departs and confirming that the work has been completed to the agreed scope.

The Customer warrants that they own the Goods or have full authority from the owner to move them and that there are no legal restrictions affecting the Goods.

Excluded and Restricted Items

The Company will not carry or handle certain items, including but not limited to:

Illegal goods, stolen goods, or items obtained unlawfully.

Explosives, firearms, ammunition, or weapons.

Hazardous, flammable, or toxic materials, including gas cylinders, paints, solvents, and chemicals, unless expressly agreed in advance.

Perishable goods that may deteriorate during transit, unless specifically agreed with the Customer.

Animals or live plants, unless otherwise agreed and safely contained.

The Company reserves the right to refuse to move any item that, in the opinion of its staff, presents a risk to safety, may cause damage to property or the Vehicle, or is not suitably prepared for transport.

Waste Regulations and Disposal

The Company operates in accordance with relevant waste and environmental regulations. The Company is not a general rubbish clearance or waste disposal business and cannot remove or dispose of domestic refuse, construction waste, or other materials classed as controlled waste unless this has been agreed as a separate waste removal service and is compliant with applicable regulations.

The Customer must not present for removal any items that are considered hazardous waste or that require special licences or facilities for disposal, unless prior arrangements have been made with the Company. Where waste removal is agreed, the Customer is responsible for accurately describing the type and quantity of waste.

If the Company is requested to dispose of unwanted items, these will be treated as waste or donations at the Companys discretion. Once removed, such items cannot be reclaimed. The Company may charge additional fees for waste transfer, recycling, or disposal costs and reserves the right to refuse items that cannot be lawfully or safely disposed of.

Access, Parking, and Delays

The Customer must ensure that there is suitable access to both collection and delivery locations for the Vehicle, including appropriate parking space close to the entrance. Any parking fees, fines, or penalties incurred as a result of insufficient information, lack of permits, or Customer actions may be charged to the Customer.

If access is restricted, requires unusual manual handling, or the Vehicle cannot be parked within a reasonable distance, additional time and charges may apply. The Company is not liable for delays caused by traffic, road closures, parking difficulties, or circumstances outside its reasonable control.

Liability and Limitations

The Company will take reasonable care in handling and transporting the Goods. However, liability is subject to the limitations and exclusions set out in these Terms and Conditions.

The Companys liability for loss of or damage to Goods, where such loss or damage arises from the Companys negligence, shall be limited to a reasonable repair or replacement cost, up to a maximum amount per job as specified by the Company from time to time. The Customer should inform the Company of any particularly valuable or fragile items in advance so that appropriate handling can be arranged.

The Company will not be liable for:

Loss or damage arising from inadequate or improper packing by the Customer.

Damage to furniture or items that are already defective, weak, or not in a suitable condition to be moved.

Damage to goods packed by the Customer in boxes or containers not supplied or packed by the Company.

Loss of data, reinstallation costs, or loss of business resulting from the movement of electronic equipment, computers, or similar devices.

Indirect or consequential losses, including loss of profit, loss of opportunity, or emotional distress.

The Company shall not be liable for any loss or damage caused by events beyond its reasonable control, including but not limited to acts of God, severe weather, accidents, road closures, public disturbances, or industrial action.

The Customer must report any apparent loss or damage to the Goods as soon as reasonably possible, and in any event within 48 hours of completion of the Services. The Company may require evidence of damage and reasonable opportunity to inspect items before any settlement is considered.

Damage to Property

The Company will take reasonable care to avoid damage to premises, fixtures, and fittings during the provision of the Services. The Customer should point out any vulnerable areas, such as weak banisters, loose flooring, or delicate surfaces, before work begins.

The Companys liability for damage to property, where such damage is caused by negligence, will be limited to the reasonable cost of repair or making good, subject to an overall cap per job as advised by the Company. The Company will not be liable for minor marks, scuffs, or wear and tear that may reasonably occur during the normal process of moving goods.

Insurance

The Company maintains appropriate insurance for its Vehicles and public liability in connection with the provision of removal services. The existence of such insurance does not extend or increase the Companys liability beyond that set out in these Terms and Conditions.

The Customer is strongly advised to arrange their own insurance cover for Goods in transit, especially for high-value items, antiques, artwork, or items of sentimental value. Any additional insurance arranged by the Customer remains their sole responsibility.

Complaints and Disputes

If the Customer is dissatisfied with any aspect of the Services, they should raise their concerns with the Company as soon as possible, allowing a reasonable opportunity for the matter to be investigated and resolved. The Customer should provide clear details of the issue and any supporting evidence.

The Company will aim to respond to complaints promptly and to reach a fair and reasonable outcome. Where a dispute cannot be resolved informally, the parties agree to consider mediation or another form of alternative dispute resolution before commencing court proceedings where practicable.

Data Protection and Privacy

The Company will collect and process personal data provided by the Customer for the purposes of administering bookings, providing the Services, issuing invoices, and managing customer relationships. The Company will handle such information in accordance with applicable data protection laws and will not sell or disclose personal data to third parties except where necessary to deliver the Services or as required by law.

Variation of Terms

The Company reserves the right to amend or update these Terms and Conditions from time to time. The version in force at the time of booking will apply to that particular service, unless changes are required by law or with the agreement of the Customer.

Severability

If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable by a court or competent authority, that provision shall be deemed severed from the remaining provisions, which shall continue to be valid and enforceable.

Governing Law and Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter or formation, shall be governed by and construed in accordance with the laws of England and Wales.

The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the provision of the Services.

Entire Agreement

These Terms and Conditions, together with any written quotation, booking confirmation, or other document expressly agreed between the Company and the Customer, constitute the entire agreement between the parties in relation to the Services. No other statement, representation, or promise shall be binding unless confirmed in writing by an authorised representative of the Company.
